Last updated: August 2026. These Terms of Service ("Terms") govern your use of the website of Apex Electric Estimating Inc ("Apex", "we", "our", or "us") and our estimating and takeoff services. Please read these Terms carefully before using our website or submitting a request for services.
1. Acceptance of Terms
By using this website or submitting a request for estimating services, you agree to be bound by these Terms. If you do not agree with any part of these Terms, please do not use our website or services. When you submit a project request, you confirm that you have the authority to agree to these Terms on behalf of yourself or the organization you represent.
2. Eligibility
Our services are intended for business and professional use by individuals and organizations involved in construction, contracting, or project management. You must be at least 18 years of age to use our services. By using our services, you represent that you meet these requirements.
3. Scope of Services
Apex Electric Estimating Inc provides construction cost estimating, electrical takeoff, and related estimating services. Estimates are prepared from the drawings and information you provide and reflect professional judgment and market data available at the time of preparation. Our deliverables include quantity takeoffs, cost estimates, and bid-ready packages in Excel with line-item detail, as agreed for each project.
Estimates are not construction bids, cost guarantees, or engineering or architectural opinions. Final project costs may vary based on field conditions, material availability, labor market changes, and the accuracy of the documents provided.
4. Service Delivery and Turnaround
Standard turnaround is 24–48 hours for most projects. Residential and light commercial work is typically completed within two business days. Larger commercial or industrial scopes may require 3–5 business days. Rush 24-hour delivery is available for urgent bid deadlines at the rates quoted.
Turnaround timelines begin once we have received your complete project documents and confirmed the scope. Any delays caused by incomplete, unreadable, or missing information may extend the delivery date, which we will communicate to you as soon as possible.
5. Pricing and Payment
Services are provided at flat-fee rates, starting from $65 per project, agreed upon before work begins. Fees are quoted after we review your project plans — typically within 15–30 minutes of receiving your documents. Payment terms are provided with each quote. Services may require full or partial payment in advance of delivery.
Quoted fees reflect the scope described in your request. Substantial changes to project scope, document revisions, or additional takeoff requirements after the quote is issued may result in an adjusted fee, which will be confirmed with you before additional work is performed.
6. Cancellation and Refunds
Because estimating work is performed on your behalf as soon as the project is scheduled, fees are non-refundable once work has begun. If you cancel before we begin work on your project, any prepaid fees will be credited toward a future project. No refunds are issued after work has commenced.
If you believe a deliverable does not meet the agreed scope, contact us within 7 days of delivery. We will review the matter and, at our discretion, correct the deliverable at no additional cost or issue a credit.
7. Client Responsibilities
You are responsible for:
- Providing complete, accurate, and legible drawings, specifications, and project information
- Ensuring you have the right to share any documents you provide to us
- Reviewing deliverables promptly and informing us of any issues
- Making your own independent verification of results before relying on them
Estimates are only as accurate as the documents provided. We are not responsible for inaccuracies caused by incomplete or incorrect project information supplied by you.
8. Confidentiality
We treat your project documents and estimate information as confidential. We use them solely for the purpose of preparing and supporting your estimate and do not share them with third parties except as needed to provide our services or as required by law. We may retain anonymized or summarized data to improve our estimating processes.
9. Intellectual Property
All content on this website, including text, graphics, logos, and branding, is the property of Apex Electric Estimating Inc and may not be reproduced, distributed, or used without our prior written permission.
Deliverables we prepare for you are provided for your use in the project described in your request. You may use them for that project, including your bid and construction procurement. You may not resell or redistribute our deliverables, methodology, or proprietary estimating data as your own or to third parties.
10. Warranty Disclaimer
Our website and services are provided on an "as is" and "as available" basis, without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, or non-infringement. 11. Limitation of Liability
To the fullest extent permitted by law, Apex Electric Estimating Inc, its owners, employees, and agents are not liable for any indirect, incidental, special, consequential, or punitive damages, including lost profits, lost bids, loss of business opportunity, or loss of data, arising from the use of our services, reliance on our estimates, or use of this website.
Our total liability for any claim arising out of or relating to our services, whether in contract, tort, or otherwise, is limited to the fees you paid for the specific project giving rise to the claim.
12. Indemnification
You agree to indemnify and hold harmless Apex Electric Estimating Inc, its owners, employees, and agents from any claims, damages, liabilities, costs, or expenses (including reasonable attorney's fees) arising out of your use of our services, your breach of these Terms, or your violation of any rights of a third party.
13. Governing Law
These Terms are governed by and construed in accordance with the laws of the State of New Jersey, USA, without regard to its conflict-of-law principles. You agree to submit to the exclusive jurisdiction of the state and federal courts located in New Jersey for any dispute arising under these Terms.
14. Dispute Resolution
Before initiating any legal proceeding, you agree to attempt to resolve any dispute in good faith through direct negotiation with us. If the dispute is not resolved within 30 days, either party may pursue the dispute in the courts of New Jersey as provided in Section 13. Nothing in this section limits either party's right to seek injunctive or equitable relief where appropriate.
15. Force Majeure
Neither party is liable for any failure or delay in performance caused by events beyond its reasonable control, including natural disasters, acts of government, pandemic, power failure, telecommunications or internet disruption, or other force majeure events. The affected party will notify the other as soon as reasonably practicable and resume performance when the event ends.
16. Changes to These Terms
We may update these Terms from time to time. The "Last updated" date at the top of this page indicates when these Terms were most recently revised. Material changes will be communicated by updating this page. Continued use of our website or services after changes take effect constitutes acceptance of the revised Terms.
17. Severability and Contact
If any provision of these Terms is found to be invalid or unenforceable, that provision will be enforced to the maximum extent permitted by law, and the remaining provisions will remain in full force and effect.
